untitled (523)A 31 year-old man has pleaded guilty to stealing a variety of sweets and kitchen foil at a sitting of today's Letterkenny District Court.

Edward Stokes with an address at 2 The Villa Granby Row, Carlow admitted to the offences which occurred on the 28th of May 2015.

There had been a bench warrant for his arrest after he failed to appear at court on June 8th 2015.

The court heard that on the night in question - Mr Stokes was extremely intoxicated and entered the Topaz Garage in Mountain Top, Letterkenny.

Mr Stokes had paid for some items but he also had products in a plastic bag that he did not pay for.

Mr Stokes was arrested by Gardaí, and they discovered the bag of stolen items which contained M&M's, Maltesers and kitchen foil.

The cost of the stolen items amounted to just over €6.

The court heard how Mr Stokes, a married man with four children has had on-going problems with alcoholism.

Mr Stokes had 19 previous convictions, and is currently serving an 11-month prison sentence for driving while disqualified and being in possession of stolen goods.

Solicitor for the defendant Mr McGrory said that Mr Stokes had been involved in a family dispute the night of the incident and his head was all over the place.

Mr McGrory told the court, "He's had his battles with alcoholism but is trying to turn his life around, he's very apologetic and embarrassed for what he has done.

He doesn't have a great recollection of the night, but the only reason he can offer as to why he did it was due to the family issues he had been experiencing.

Judge Paul Kelly took into account that Mr Stokes cooperated fully with Gardaí and was genuinely remorseful for what he done.

He fined him €250 for theft and €100 for failing to appear at a previous court sitting.
