Judge Paul Kelly has adjourned a number of drink-driving cases until March - as he awaits the results of an appeal lodged in the Court of Appeal.
Hundreds of drink-driving cases were adjourned following the legal challenge brought by a Romanian national who was not given details of a breath test in Irish.
Mihai Avadenei (28), of Lioscianan, Swords, Co Dublin, had his case supported by a district judge and the High Court agreed with the decision taken there.
The DPP however has appealed the decision.
There were a series of pending drink-driving cases to be heard at Letterkenny District Court this week.
However, Judge Paul Kelly adjourned the cases pending a State appeal of the High Court ruling to the Court of Appeal.
The Judge gave a decision in which he pointed out that he had facilitated defendants for almost a year in adjourning their cases to await the outcome of the High Court Case.
He also explained that the State (DPP) had now requested an adjournment to allow their appeal to the Court of Appeal be heard. Cases were adjourned until next March.
